Why Do Students with Disabilities Drop Out of High School - Essay Example The study is focused in finding out the reasons why the special education students drop out, hence putting emphasis on the students’ experiences. The method to use in this type of study is the phenomenological approach which asserts that the meaning of phenomena can be understood through the experiences of those who are involved (Wiggan, 2008, p. 322). Research Questions Given this objective, the key question that will be answered in this proposed study is â€Å"Why do students with disabilities drop out of high school?† This chapter discusses how this question will be answered. Because it is a â€Å"why† question, the qualitative methodology was selected as it is more appropriate when contending with such abstract human behaviors, such as the act of dropping out of school. This proposed study requires a flexible research design because it addresses a human phenomenon that should also make space for behavioral factors. Hence, the qualitative method’s objec tives of describing and explaining variations, relationships, individual experiences and group norms make it the most suitable for this study. For instance, when observing and interviewing participants, the set of interview questions determined beforehand should allow enough room for follow-up questions. This is by using a nonstructured format (Morocco, et al, 2006). Likewise, analyzing the data to be gathered will involve flexibility as categories that are not expected will arise and factors that seem inconsequential may became significant. The study may need to be adjusted in the coding and analysis of the data as these previously insignificant factors and categories may become more important in order to be able to present more accurate and comprehensive results. Design Qualitative research can â€Å"see precisely which events led to which consequences and derive fruitful explanations† (Miles and Huberman, 1994, p. 1). Moreover, it has a higher chance of being able to arriv e at unanticipated findings and new combinations and reationships (Miles and Huberman, 1994). These reasons are why the qualitative research design has been selected for this study as it can provide a clear view of why students with disabilities drop out of high school. It must be clarified that although quantitative data, such as statistics and percentages, will be used in the study, it only serves as supportive numbers that will lay the groundwork for this study. Furthermore, it is intended for this qualitative research to act as a precursive study for more accurate and extensive quantitative study on the same topic. Active Observation The study will employ a qualitative research design that will be based on active observation with â€Å"a nonstructured format to allow for maximum flexibility† (Morocco, et al, 2006, p. 140). The qualitative research design has been criticized by many for its supposed inexactness due to its â€Å"interpretative, subjective, impressionistic and diagnostic† nature as it has been claimed that there are no unbiased observers (Thomson, 2007). However, when contending with abstract data, like â€Å"the often contradictory behaviors, beliefs, opinions, emotions, and relationships of individuals† and in this case, the reasons why certain people act a particular way, active observation is best employed as its strength lies in its capability to be able to provide a textual characterization of complex events such as human experience (Mack, et al., 2005). Intensive Interview Data will be collected through intensive interviews of special education high school student dropouts through personal (face-to-face) meetings and via electronic mail (e-mail). Federal entitlement spending will sharply increase due to lack of preparation (saving money) for â€Å"old age† by baby boomers. The some 76 million baby boomers born between 1946 and 1964 are anticipated to double the burden on Medicare, Medicaid, and Social Security by 2035. While advances in science and technology have greatly expanded the capabilities of medical science, disproportionate increases in the use of health services have been fueled by the lack of effective means to channel patients into consuming, and providers into offering, only appropriate services. The function of the gallbladder in the human body is to solve and concentrate bile, which is produced by the liver and is necessary for proper digestion of fats. What are Gallstones? Gallstones form when the liquid stored in the gallbladder hardens into pieces of stone-like material. The liquid, called bile is used to help the body digest fats. Bile is made in the liver, and then stored in the gallbladder until the body needs to digest fat. At that time, the gallbladder contracts and pushes the bile into a tube—called the common bile duct—that carries it to the small intestine, where it help with digestion. Bile contains water, cholesterol, fats, bile salts, proteins, and bilirubin. Bile salts breaks up fats, and bilirubin gives bile and stool a yellowish color. If the liquid bile contains too much cholesterol, bile salts, or bilirubin, under certain conditions it can harden into stones. They may occur as a simple, large stone or many small ones. Gallstones are mixtures of compound, but are mostly cholesterol. According to studies many people have gallstones and never know it. Three Major Perspectives in Sociology Essay

Three Major Perspectives in Sociology Sociologists analyze social phenomena at different levels and from different perspectives. From concrete interpretations to sweeping generalizations of society and social behavior, sociologists study everything from specific events (the microlevel of analysis of small social patterns) to the â€Å"big picture† (the macro level of analysis of large social patterns). The pioneering European sociologists, however, also offered a broad conceptualization of the fundamentals of society and its workings. Their views form the basis for today’s theoretical perspectives, or paradigms, which provide sociologists with an orienting framework—a philosophical position—for asking certain kinds of questions about society and its people. Sociologists today employ three primary theoretical perspectives: the symbolic interactionist perspective, the functionalist perspective, and the conflict perspective. These perspectives offer sociologists theoretical paradigms for explaining how society influences people, and vice versa. Each perspective uniquely conceptualizes society, social forces, and human behavior (see Table 1). Read more: Functionalist Conflict and Interactionist Perspectives The symbolic interactionist perspective The symbolic interactionist perspective, also known as symbolic interactionism, directs sociologists to consider the symbols and details of everyday life, what these symbols mean, and how people interact with each other. Although symbolic interactionism traces its origins to Max Weber’s assertion that individuals act according to their interpretation of the meaning of their world, the American philosopher George H. Mead (1863–1931) introduced this perspective to American sociology in the 1920s. According to the symbolic interactionist perspective, people attach meanings to symbols, and then they act according to their subjective interpretation of these symbols. Verbal conversations, in which spoken words serve as the predominant symbols, make this subjective interpretation especially evident. The words have a certain meaning for the â€Å"sender,† and, during effective communication, they hopefully have the same meaning for the â€Å"receiver.† In other terms, words are not static â€Å"things†; they require intention and interpretation. Conversation is an interaction of symbols between individuals who constantly interpret the world around them. Of course, anything can serve as a symbol as long as it refers to something beyond itself. Written music serves as an example. The black dots and lines become more than mere marks on the page; they refer to notes organized in such a way as to make musical sense. Thus, symbolic interactionists give serious thought to how people act, and then seek to determine what meanings individuals assign to their own actions and symbols, as well as to those of others. Consider applying symbolic interactionism to the American institution of marriage. Symbols may include wedding bands, vows of life†long commitment, a white bridal dress, a wedding cake, a Church ceremony, and flowers and music. American society attaches general meanings to these symbols, but individuals also maintain their own perceptions of what these and other symbols mean. For example, one of the spouses may see their circular wedding rings as symbolizing â€Å"never ending love,† while the other may see them as a mere financial expense. Much faulty communication can result from differences in the perception of the same events and symbols. Critics claim that symbolic interactionism neglects the macro level of social interpretation—the â€Å"big picture.† In other words, symbolic interactionists may miss the larger issues of society by focusing too closely on the â€Å"trees† (for example, the size of the diamond in the wedding ring) rather than the â€Å"forest† (for example, the quality of the marriage). The perspective also receives criticism for slighting the influence of social forces and institutions on individual interactions. The functionalist perspective According to the functionalist perspective, also called functionalism, each aspect of society is interdependent and contributes to society’s functioning as a whole. The government, or state, provides education for the children of the family, which in turn pays taxes on which the state depends to keep itself running. That is, the family is dependent upon the school to help children grow up to have good jobs so that they can raise and support their own families. In the process, the children become law†abiding, taxpaying citizens, who in turn support the state. If all goes well, the parts of society produce order, stability, and productivity. If all does not go well, the parts of society then must adapt to recapture a new order, stability, and productivity. For example, during a financial recession with its high rates of unemployment and inflation, social programs are trimmed or cut. Schools offer fewer programs. Families tighten their budgets. And a new social order, stability, and productivity occur. Functionalists believe that society is held together by social consensus, or cohesion, in which members of the society agree upon, and work together to achieve, what is best for society as a whole. Emile Durkheim suggested that social consensus takes one of two forms: Mechanical solidarity is a form of social cohesion that arises when people in a society maintain similar values and beliefs and engage in similar types of work. Mechanical solidarity most commonly occurs in traditional, simple societies such as those in which everyone herds cattle or farms. Amish society exemplifies mechanical solidarity. In contrast, organic solidarity is a form of social cohesion that arises when the people in a society are interdependent, but hold to varying values and beliefs and engage in varying types of work. Organic solidarity most commonly occurs in industrialized, complex societies such those in large American cities like New York in the 2000s. The functionalist perspective achieved its greatest popularity among American sociologists in the 1940s and 1950s. While European functionalists originally focused on explaining the inner workings of social order, American functionalists focused on discovering the functions of human behavior. Among these American functionalist sociologists is Robert Merton (b. 1910), who divides human functions into two types: manifest functions are intentional and obvious, while latent functions are unintentional and not obvious. The manifest function of attending a church or synagogue, for instance, is to worship as part of a religious community, but its latent function may be to help members learn to discern personal from institutional values. With common sense, manifest functions become easily apparent. Yet this is not necessarily the case for latent functions, which often demand a sociological approach to be revealed. A sociological approach in functionalism is the consideration of the relationship between the functions of smaller parts and the functions of the whole. Functionalism has received criticism for neglecting the negative functions of an event such as divorce. Critics also claim that the perspective justifies the status quo and complacency on the part of society’s members. Functionalism does not encourage people to take an active role in changing their social environment, even when such change may benefit them. Instead, functionalism sees active social change as undesirable because the various parts of society will compensate naturally for any problems that may arise. The conflict perspective The conflict perspective, which originated primarily out of Karl Marx’s writings on class struggles, presents society in a different light than do the functionalist and symbolic interactionist perspectives. While these latter perspectives focus on the positive aspects of society that contribute to its stability, the conflict perspectivefocuses on the negative, conflicted, and ever†changing nature of society. Unlike functionalists who defend the status quo, avoid social change, and believe people cooperate to effect social order, conflict theorists challenge the status quo, encourage social change (even when this means social revolution), and believe rich and powerful people force social order on the poor and the weak. Conflict theorists, for example, may interpret an â€Å"elite† board of regents raising tuition to pay for esoteric new programs that raise the prestige of a local college as self†serving rather than as beneficial for students. Whereas American sociologists in the 1940s and 1950s generally ignored the conflict perspective in favor of the functionalist, the tumultuous 1960s saw American sociologists gain considerable interest in conflict theory. They also expanded Marx’s idea that the key conflict in society was strictly economic. Today, conflict theorists find social conflict between any groups in which the potential for inequality exists: racial, gender, religious, political, economic, and so on. Conflict theorists note that unequal groups usually have conflicting values and agendas, causing them to compete against one another. This constant competition between groups forms the basis for the ever†changing nature of society. Critics of the conflict perspective point to its overly negative view of society. The theory ultimately attributes humanitarian efforts, altruism, democracy, civil rights, and other positive aspects of society to capitalistic designs to control the masses, not to inherent interests in preserving society and social order. Feminist theory is one of the major contemporary sociological theories, which analyzes the status of women and men in society with the purpose of using that knowledge to better women’s lives. Feminist theorists have also started to question the differences between women, including how race, class, ethnicity, and age intersect with gender. Feminist theory is most concerned with giving a voice to women and highlighting the various ways women have contributed to society. There are four main types of feminist theory that attempt to explain the societal differences between men and women: Gender Differences: The gender difference perspective examines how women’s location in, and experience of, social situations differ from men’s. For example, cultural feminists look to the different values associated with womanhood and femininity as a reason why men and women experience the social world differently. Other feminist theorists believe that the different roles assigned to women and men within institutions better explain gender difference, including the sexual division of labor in the household. Existential and phenomenological feminists focus on how women have been marginalized and defined as the â€Å"other† in patriarchal societies. Women are thus seen as objects and are denied the opportunity for self-realization. Gender Inequality: Gender-inequality theories recognize that women’s location in, and experience of, social situations are not only different but also unequal to men’s. Liberal feminists argue that women have the same capacity as men for moral reasoning and agency, but that patriarchy, particularly the sexist patterning of the division of labor, has historically denied women the opportunity to express and practice this reasoning. Women have been isolated to the private sphere of the household and, thus, left without a voice in the public sphere. Even after women enter the public sphere, they are still expected to manage the private sphere and take care of household duties and child rearing. Liberal feminists point out that marriage is a site of gender inequality and that women do not benefit from being married as men do. Indeed, married women have higher levels of stress than unmarried women and married men. According to liberal feminists, the sexual division of labor in both the public and private spheres needs to be altered in order for women to achieve equality. Gender Oppression: Theories of gender oppression go further than theories of gender difference and gender inequality by arguing that not only are women different from or unequal to men, but that they are actively oppressed, subordinated, and even abused by men. Power is the key variable in the two main theories of gender oppression: psychoanalytic feminism and radical feminism. Psychoanalytic feminists attempt to explain power relations between men and women by reformulating Freud’s theories of the subconscious and unconscious, human emotions, and childhood development. They feel that conscious calculation cannot fully explain the production and reproduction of patriarchy. Radical feminists argue that being a woman is a positive thing in and of itself, but that this is not acknowledged in patriarchal societies where women are oppressed. They identify physical violence as being at the base of patriarchy, but they think that patriarchy can be defeated if women recognize their own value and strength, establish a sisterhood of trust with other women, confront oppression critically, and form female separatist networks in the private and public spheres. Structural Oppression: Structural oppression theories posit that women’s oppression and inequality are a result of capitalism, patriarchy, and racism. Socialist feminists agree with Karl Marx and Freidrich Engels that the working class is exploited as a consequence of the capitalist mode of production, but they seek to extend this exploitation not just to class but also to gender. Intersectionality theorists seek to explain oppression and inequality across a variety of variables, including class, gender, race, ethnicity, and age. They make the important insight that not all women experience oppression in the same way. White women and black women, for example, face different forms of discrimination in the workplace. The chief character in the narrative â€Å"The Man Who Loves Flowers† by Stephen King from 1977. In the get downing the narrative is sweet. it is truly romantic. Chromatin Isolation essays DNA is the blueprint for all living things. DNA is made of a material called chromatin. The purpose of this experiment was to attempt to isolate, or separate, chromatin from onion cells. My lab partner was Dave Sugg. Hypothesis: We should be able to isolate DNA from onion cells. Procedure: To begin, weigh out about 15 grams of onion cubes and place it in a 400 ml beaker. Add about 60 ml of homogenizing medium to the onion cubes. Place it in a warm water bath for 8 minutes. Dont let it tip over!!! This softens onion tissue and allows homogenizing medium to penetrate the onion. The enzymes also get denatured. Quickly cool the solution to 15-20 degrees Celsius in an ice bath. Dont let it tip over!! Put the cooled solution in a blender. Blend for 45 seconds at high speed. Pour the result into a 500 ml beaker. Put this into an ice bath for 8 minutes. Set up a filter (cheesecloth 2 layers) in a funnel during the 8 minute wait. Pour the white solution through the filter into the other 500 ml beaker (leave the foam behind!). Take 25 ml of filtrate and pour it into a clean 250 ml Erlenmeyer flask. Put the flask in an ice bath until it cools to 10 15 degrees Celsius. Slowly add 50 ml of ice cold ethanol down the side of the flask until a white, stringy chromatin pr ecipitate occurs (the stuff will look stringy and cloudy). Wind the stringy DNA on a glass rod by turning the rod in one direction only. Data: Before we poured the ice cold ethanol down the side of the flask in the final step, there was a film at the top of the solution. We poured in all 80 ml of ethanol. There were 3 clear layers; a clear ethanol layer at the top, a DNA interface, clear with whitish strands, and quite visible unlike the protein, and a yellow homogenate at the bottom. William Rosecrans - General William Rosecrans - Civil War - Army of the Cumberland William Rosecrans - Early Life Career: William Starke Rosecrans was born at Little Taylor Run, OH on September 6, 1819. The son of Crandall Rosecrans and Jemima Hopkins, he received little formal education as a youngster and was forced to rely on what he could learn from books. Leaving home at age thirteen, he clerked at a store in Mansfield, OH before attempting to obtain an appointment to West Point from Representative Alexander Harper. Meeting with the congressman, his interview proved so impressive that he received the appointment that Harper had intended to give to his son. Entering West Point in 1838, Rosecrans proved a gifted student. Dubbed Old Rosy by his classmates, he excelled in the classroom and graduated ranked 5th in a class of 56. For this academic achievement, Rosecrans was assigned to the Corps of Engineers as a brevet second lieutenant. Marrying Anna Hegeman on August 24, 1843, Rosecrans received a posting to Fort Monroe, VA. After a year there, he requested and was granted a transfer back to West Point to teach engineering. With the outbreak of the Mexican-American War in 1846, he was retained at the academy while his classmates went south to fight. William Rosecrans - Leaving the Army: While the fighting raged, Rosecrans continued teaching before moving to Rhode Island and Massachusetts on engineering assignments. Later ordered to the Washington Navy Yard, Rosecrans began seeking civilian jobs to aid in supporting his growing family. In 1851, he sought a teaching post at the Virginia Military Institute, but turned down when the school hired Thomas J. Jackson. In 1854, after suffering from declining health, Rosecrans left the US Army and took a position with a mining company in western Virginia. A skillful businessman, he prospered and later formed an oil refining company in Cincinnati, OH. William Rosecrans - The Civil War Begins: Badly burned during an accident in 1859, Rosecrans required eighteen months to recover. His return to health coincided with the start of the Civil War in 1861. Offering his services to Ohio Governor William Dennison, Rosecrans was initially made an aide-de-camp to Major General George B. McClellan before being promoted to colonel and given command of the 23rd Ohio Infantry. Promoted to brigadier general on May 16, he won victories at Rich Mountain and Corricks Ford, though credit went to McClellan. When McClellan was ordered to Washington after the defeat at Bull Run, Rosecrans was given command in western Virginia. Eager to take action, Rosecrans lobbied for a winter campaign against Winchester, VA but was blocked by McClellan who promptly transferred away most of his troops. In March 1862, Major General John C. Frà ©mont replaced Rosecrans and he was ordered west to command two divisions in Major General John Popes Army of the Mississippi. Taking part in Major General Henry Hallecks Siege of Corinth in April and May, Rosecrans received command of the Army of the Mississippi in June when Pope was ordered east. Subordinate to Major General Ulysses S. Grant, Rosecrans argumentative personality clashed with his new commander. William Rosecrans - The Army of the Cumberland: On September 19, Rosecrans won the Battle of Iuka when he defeated Major General Stirling Price. The following month, he successfully defended Corinth though his men were hard-pressed for much of the battle. In the wake of the fighting, Rosecrans earned Grants ire when he failed to quickly pursue the beaten enemy. Hailed in the northern press, Rosecrans twin victories earned him command of XIV Corps which was soon renamed the Army of the Cumberland. Replacing Major General Don Carlos Buell who had recently checked the Confederates at Perryville, Rosecrans was promoted to major general. Re-equipping the army at Nashville, TN through November, Rosecrans came under fire from Halleck, now general-in-chief, for his inaction. Finally moving out in December, marched to attack General Braxton Braggs Army of Tennessee near Murfreesboro, TN. Opening the Battle of Stones River on December 31, both commanders intended to attack the others right flank. Moving first, Braggs assault drove back Rosecrans lines. Mounting a strong defense, the Union troops were able avert disaster. After both sides remained in place on January 1, 1863, Bragg again attacked the next day and sustained heavy losses. Unable to defeat Rosecrans, Bragg withdrew to Tullahoma, TN. Remaining at Murfreesboro for the next six months to reinforce and refit, Rosecrans again drew criticism from Washington for his inaction. After Halleck threatened to send some his troops to aid in Grants Siege of Vicksburg, the Army of the Cumberland finally moved out. Beginning on June 24, Rosecrans conducted the Tullahoma Campaign which saw him use a brilliant series of maneuvers to force Bragg out of central Tennessee in little more than a week while sustaining fewer than 600 casualties. William Rosecrans - Disaster at Chickamauga: Though a tremendous success, his accomplishment failed to garner major attention, much to his ire, due to the Union victories at Gettysburg and Vicksburg. Pausing to assess his options, Rosecrans pressed on in late August. As before, he out-maneuvered Bragg and forced the Confederate commander to abandon Chattanooga. Union troops took the city on September 9. Abandoning the cautiousness that had been part of his earlier operations, Rosecrans pushed into northwest Georgia with his corps widely spread apart. When one was nearly beaten by Bragg at Daviss Cross Roads on September 11, Rosecrans ordered the army to concentrate near Chickamauga Creek. On September 19, Rosecrans met Braggs army near the creek and opened the Battle of Chickamauga. Recently reinforced by Lieutenant General James Longstreets corps from Virginia, Bragg began a series of attacks on the Union line. Holding through the day, Rosecrans army was driven from the field the next day after a poorly-worded order from his headquarters inadvertently opened a large gap in the Union line through which the Confederates attacked. Retreating to Chattanooga, Rosecrans attempted to organize a defense while Major General George H. Thomas delayed the Confederates. William Rosecrans - Removal from Command: Though he established a strong position at Chattanooga, Rosecrans was shattered by the defeat and his army was soon besieged by Bragg. Lacking the initiative to break out, Rosecrans position worsened. To remedy the situation, President Abraham Lincoln unified Union command in the West under Grant. Ordering reinforcements to Chattanooga, Grant arrived in the city and replaced Rosecrans with Thomas on October 19. Traveling north, Rosecrans received orders to command the Department of Missouri in January 1864. Overseeing operations, he defeated Prices Raid that fall. As a War Democrat, he was also briefly considered as a running mate for Lincoln in the 1864 election as the president was seeking a bi-partisan ticket. Briefly serving as US Ambassador to Mexico, he was quickly replaced with Grant became president. Huck Finn - Life On The River Essay -- essays research papers

The difference between life on the river and life in the towns along the river is an important theme in the novel ‘The Adventures of Huckleberry Finn’ by Mark Twain. Twain uses language to draw the contrast effectively as well as through the atmosphere that has been created, the diction, the punctuation and the figures of speech employed. The two paragraphs, which most effectively display this contrast, refer to the peaceful life on the river and the vile nature of the streets and lanes of a town. This is term that is used to describe a reaction of localized tissues that is irritated, or can be cause because of an injury, infection, redness and swelling. There are several types of disease that cause severe inflammation, one disease that is very bad is Encephalitis this is an inflammation of the brain. This particular condition can happen to anyone at any age, all over the world. If encephalitis develops very rapidly, it can cause serious problems to the nervous system and the brain. If the body produces antibodies to fight the inflammation there’s a chance that they could make a mistake and attack the healthy brain tissue instead of the tissue that is inflamed. If this is not cured it could end up being life threatening. This is just one of many infections that cause by inflammation. How body reacts to inflammation are is by detecting where the exact location the inflammation is. When the body knows where it is it can send out anti bodies to eat the infection that is causing the inflammation. The symptoms of inflammation are it can be red and warm because of a large amount of blood reaching the swollen area. It can be very painful at time especially at the site of infection. There are many way to relief the pain, redness, and swelling is to put ice on it, also some inflammatory ointment can also be used to help reduce the sign of inflammation. Normally the inflammation only last till the infection has been totally healed after that there should no long be any inflammation. Sometimes during the process of the cells healing itself the cells can die of lack of nutrients known necrotic death, another way that the cells can die is from committing suicide by destroying themselves, this is known as Apoptotic death. When our body finds that there is an inflammation our body quickly reposed and kills the intruder. Then once the infection has been killed then the inflammation should go away. There are so many various things that can cause an inflammation in our body.

Verbal bullying, this includes name calling, insults, sarcasm, spreading rumours and persistent teasing. Bullying can be carried out by one person against another or by groups of others ganging up on a person, bullying can have many consequences. Critically evaluate McGregor’s Theory X and Theory Y. How far is it applicable to management and employee motivation in contemporary Chinese organizations? During the 1960s the number of psychologists invented motivational theories, which aimed to increase organizations’ productivity. One of those is McGregor’s Theory X and Theory Y, in which he claimed that people can be managed in two extremes, based on the grounds of their needs. After publishing his work had a significant impact on management ideas. Head (2011) states, that in present days, his approaches of management can be successfully applied in different countries, as well as in China. However, despite the modernization of modern working environment in China, there are still the number of hardships that make the adaptation of his theories complex and difficult. From the year of publication, McGregor’s work made a significant influence on the management philosophy. Most of the management books include his theory as an example of the substantial step of management insights (Jastolka, 2009). It was stated by Head (2011), that most of the managers prefer to use one of those, instead of other approaches. Later, after McGregor’s publication the contribution for a deeper research of labor’s motivation was made. Also, McGregor’s work persuaded managers to believe that employees’ behavior can be predicted using scientific metho ds. Afterwards the research has been conducted, therefore the deeper understanding of human’s motivation can be gained (Head, 2011). The appliance of both methods can be successful, depending on which sphere the company is specializing in. According to Bobic and Davis (2003), adaptive approach, or Theory X works with highly routine and detailed tasks. Additionally, it is more appropriate for firms with bureaucratic structures (Kirton, 1978; cited in Bobic and Davis, 2003). Such organizations have hierarchical systems with clearly distinguished responsibilities and roles. Regarding to the innovative technique, or Theory Y, it responds more efficiently with complicated tasks that require special skills (Sorensen, 2011). In spite of listed advantages, McGregor’s work was criticized for the number of weaknesses. Firstly, technological development, new forms of businesses and other improvements in the organization of production leaded to the alteration of employees’ responsibilities, and formed new types of jobs. It was claimed by Bobic and Davis (2003), that present workers have different working settings, in the comparison to the working environment in  1960s. Thus, it is fallaciously to regard this theory as a beneficial explanation of contemporary humans’ motivation. Secondly, people have a set of characteristics, which makes every person unique, and it is far too complex to distinguish them between only two groups. For example, Theory X does not take the diversity of individuals into the consideration (Miner, 2002; cited in Jastolka, 2009). Finally, McGregor’s hypothesis is mostly founded on Maslow’s hierarchy of needs, which validity is criticized (Heylighen, 1992; cited in Bobic and Davis, 2003). Furthermore, Maslow’s work was based on the empirical base of America, and its applicability to other countries has not been successfully proven yet. In case of China, its working environment is slightly becoming similar to Western, because in 1979 Chinese government began to implement economic policies to create an economy with capitalistic features, such as profit orientation, private owning and market forces (Francesco and Gold, 2005). Such changes significantly influenced the way, in which Chinese workers are treated by their managers, forcing them to practice methods that used in Western nations, however despite these changes, implementing of McGregor’s methods is hard for certain reasons. First of all, according to Francesco and Gold (2005), the management style of a country, such as China, with strong traditions and remained patriarchy, is hard to be transformed or altered. For example, Garg and Ma (2005) conducted a research, which shows the difference between frameworks of organizations. The participants of survey were three groups of firms, with different introduction of non-Chinese executives, who use Western management approaches: complete, partial and blank, and result shows a significant difference between these companies in some aspects of working conditions. In organizations with only Chinese executives, most of employees experience an unavailability of managers, lack of encouragement to be innovative and lack of support most of the time. However, it could be argued that the conditions described above could be associated with Theory X. Secondly, Chinese employees in firms function as a group where each member is working for the prosperity of the whole company (Francesco and Gold, 2005). This feature restrains the enthusiasm of workers to be innovative in their job in order to maximize the profit of his/her company, but coerce them to do their tasks conventionally, because employees are anxious to harm their firm, while Theory Y assumes that people must have more freedom. Hamilton gives the anxiety of their time that because the legislature holds the purse strings and the executive the sword of society, the impartiality of the courts can be undermined, that it is the weakest branch of government with neither will nor force to enforce its judgement. Considering the fact that the the constitution provides for certain limitations which the legislature is proscribed from enacting such as bill of attainder, ex-post facto law, the question arosed on how the courts may declare such unconstitutional law null and void with impartiality and justice. Hamilton rationalized that the two non-judicial branches must not take offense for the declaration of their acts as unconstitutional as one of interference because the court is only declaring the letter of the constitution and did not do so as one superior to them, that the act does not constitute a substitution of their will or pleasure. The constitution, in order to assure the independence of judges, declares their tenure of service as permanent based pm good behavior. The periodic appointment of judges would likely indebt them to either executive or legislative branch responsible for their appointment. The independence of the judiciary is essential to the enforcement of the constitution because it is an aspect, like that of separation of powers, of the concept of "checks and balance" and ultimately of governance. Judicial independence is not only a normative ideal but an institutional virtue as well. And in the said virtue and ideal lies the capacity of the courts to protect individual rights, to police the structural limits of governmental power and to decide individual disputes based on the applicable law and the factual records of each case without regard to intimidation or other impermissible influences, if any. Judge Learned Hand (1958) urged caution in the exercise of judicial power. He considered the source and nature of the power of judicial constitutional review as necessary to prevent the failure of the government created by the constitution. He also proposed judicial restraint, saying that the power should be "confined to the need that evoked it" meaning, as a check on the usurpation of power by the other branches. For him the judiciary plays the necessary role in maintaining a government "between absolutism and the kind of democracy that so often prevailed in Greek cities during the sixth to fourth centuries before our era." Like Hamilton and Montesquieu, Hand believes that no single branch should have absolute power, especially not the judiciary. Modern thinkers (Shane, 1998) proffer that the paradigm of judicial restraint may often be misleading, unhelpful and even counter-productive. They propose another paradigm, that of "inter-branch accountability." They admit that "every branch has the power to make life more difficult for
